Terms and Conditions

1. THE AGREEMENT

1.1 Application: These Terms apply to all forklift training, testing, and certification

(“Services”).

1.2 Acceptance: A “Booking” is confirmed when you accept our quote in writing or

via our online system.

1.3 B2B vs. B2C: These terms apply to Business Customers and individual

Consumers. Where specific statutory rights apply to Consumers (individuals), these

are highlighted in Section 10.

2. TRAINING PREREQUISITES & SAFETY

2.1 Candidate Eligibility: You are responsible for ensuring candidates are physically

fit, have the required literacy/numeracy for the theory element, and meet the

minimum age requirements for the category of lift truck being trained.

2.2 Identification: All candidates must produce valid photo ID on the first day of

training. Failure to do so may result in the candidate being excluded without a refund.

2.3 PPE: Candidates must wear appropriate Personal Protective Equipment (PPE),

including safety footwear and high-visibility vests. We reserve the right to refuse

training to any candidate without correct PPE.

2.4 Sobriety: We operate a zero-tolerance policy for drugs and alcohol. If an

instructor suspects a candidate is under the influence, training will cease immediately,

and the full fee will be forfeited.

3. PREMISES AND EQUIPMENT

3.1 Training at Your Premises: If training occurs at your site, you must provide:

o A safe, cordoned-off training area.

o A forklift in good working order with a valid Report of Thorough

Examination (LOLER).

o Sufficient loads/pallets for practical exercises.

3.2 Inspection: We reserve the right to cancel training if the equipment or area is

deemed unsafe. In such cases, the full booking fee remains payable.

4. FEES AND PAYMENT

4.1 Rates: Fees include tuition and, where specified, one attempt at the theory and

practical tests.

4.2 Out-of-Hours: Training scheduled for weekends, bank holidays, or night shifts

(outside 08:00–18:00) is subject to a 150% surcharge unless otherwise agreed.

4.3 Late Payment: * B2B: Interest will be charged at 8% above the Bank of

England base rate per the Late Payment of Commercial Debts Act 1998.

o B2C: Interest will be charged at 3% above the Bank of England base rate.

4.4 Certification: Certificates and ID cards will only be issued once cleared funds

are received in full.

5. CANCELLATION AND POSTPONEMENT

5.1 Notice Periods:

o Less than 7 days’ notice: 100% of the Booking fee is payable.

o 7 days to 1 calendar month: 50% of the Booking fee is payable.

o More than 1 month: No charge.

5.2 Failure to Attend: No refund or credit is given for candidates who fail to attend

or arrive too late to participate in the mandatory safety briefing.

5.3 Postponement: If a booking is postponed and not re-booked within 6 months, all

fees are forfeited.

6. INTELLECTUAL PROPERTY & ACCREDITATION

6.1 Materials: All training manuals and digital resources remain our property. You

may not copy or redistribute them.

6.2 Accreditation: We will register successful candidates with the relevant

accrediting body (e.g., RTITB/ITSSAR) provided all fees are paid. We are not liable

for delays caused by the accrediting body.

7. LIMITATION OF LIABILITY

7.1 General: We do not exclude liability for death or personal injury caused by our

negligence.

7.2 Cap: Our total liability for any claim shall not exceed the total fees paid for the

specific training booking.

7.3 Consequential Loss: We are not liable for any loss of production, loss of profit,

or costs associated with hiring replacement operators while training is conducted.8. DATA PROTECTION

8.1 UK GDPR: We process candidate data (name, DOB, NI number, photo)

specifically for certification and registration with accrediting bodies.

8.2 Records: We will maintain training records as required by the HSE (L117).

9. TERMINATION

9.1 Notice: Either party may terminate this agreement with one month’s written

notice. This does not affect sessions already booked within that period.

10. SPECIAL CONSUMER TERMS (B2C ONLY)

10.1 Statutory Rights: If you are a Consumer, your rights under the Consumer

Rights Act 2015 apply.

10.2 Cooling-Off: If you book online, you have a 14-day right to cancel. However,

if you request the training to start within this period, you must pay for the services

provided up to the point of cancellation.

10.3 Cancellation Fees: For consumers, cancellation fees in Section 5 will be limited

to the actual costs/losses we have incurred.

11. LAW

11.1 Jurisdiction: These terms are governed by the laws of England and Wales and

are subject to the exclusive jurisdiction of the English courts.
